Objective
The Silenced No More Act is a California law, formally known as Senate Bill 331, that significantly restricts the use of Non-Disclosure Agreement (NDA)s and Non-Disparagement clauses. Effective January 1, 2022, it expands upon previous legislation that only covered sexual harassment and gender discrimination. Under this act, employers are prohibited from using agreements that prevent employees from disclosing information about any form of unlawful workplace harassment, discrimination, or retaliation, including those based on race, religion, disability, or age. It specifically allows workers to discuss their experiences with the media, social circles, or future employers.
